Acceptance of terms
By accessing or using raraaviscigars.com or the Rara Avis watchlist and alert service (together, "Rara Avis," "we," "us"), you agree to these Terms of Service. If you don't agree, don't use the service.
Eligibility
Rara Avis concerns tobacco products. You must be at least 21 years old to use the service, and by using it you represent that you are.
What Rara Avis is — and isn't
Rara Avis is a tracking and alert service. We watch third-party retailers for allocation, restock, and pre-release activity on cigar products, and we tell you about it. Rara Avis is not a retailer. We do not sell tobacco products, and no sale, shipment, or payment for tobacco products happens through us. Every purchase you make happens directly with the retailer, on their site, under their own terms.
Accuracy of listings and alerts
We work to verify alerts before we send them, and we track how often each retailer's stock signals hold up over time. Even so, retailer inventory changes constantly and outside our control, and we cannot guarantee that any listing, alert, or price shown is accurate, current, or that an item will still be available by the time you reach the retailer's site. Always confirm availability and price directly with the retailer before relying on anything we send.
Accounts
You're responsible for the accuracy of the information on your account and for any activity that happens through it. Sign-in uses a one-time emailed link rather than a password — keep your email account secure, since access to it is access to your Rara Avis account.
Subscriptions and billing
Rara Avis offers free browsing and a paid Reserve tier (watchlists and instant alerts), billed and processed through Stripe. Reserve is available billed monthly ($9.99/month) or annually ($99.99/year). Subscriptions renew automatically each billing period until cancelled.
You can cancel anytime; cancellation takes effect at the end of the current billing period, and you keep Reserve access through that period. Payments are non-refundable except where required by law.
Referral program
Reserve members can share a referral link or code. A referral reward (a free month) is granted only once the referred person actually subscribes to Reserve — not simply for signing up or clicking the link. We reserve the right to withhold or reverse rewards obtained through fraud, abuse, self-referral, or fake accounts.
Prohibited conduct
You agree not to:
- Use the service for any unlawful purpose, including underage tobacco purchasing
- Attempt to scrape, reverse-engineer, or interfere with the service or its alerts
- Abuse the referral program through fake accounts or fraudulent conversions
- Misrepresent your identity, age, or account information
Third-party retailers
Rara Avis has no control over, and no responsibility for, the retailers we track — their pricing, inventory accuracy, shipping, customer service, or legal compliance. Your purchase relationship is with the retailer, not with us.
Intellectual property
The Rara Avis name, branding, and the service itself are our property. You may not copy, reproduce, or repurpose them without our permission.
Disclaimer of warranties
The service is provided "as is" and "as available," without warranties of any kind, express or implied, including accuracy, uninterrupted availability, or fitness for a particular purpose.
Limitation of liability
To the fullest extent permitted by law, Rara Avis is not liable for any indirect, incidental, or consequential damages arising from your use of the service, including a missed release, an inaccurate alert, or any transaction with a third-party retailer.
Indemnification
You agree to indemnify and hold Rara Avis harmless from any claim arising from your use of the service or your violation of these terms.
Termination
We may suspend or terminate your account if you violate these terms. You may stop using the service, or delete your account, at any time.
Governing law
These terms are governed by the laws of the State of Oregon, without regard to its conflict-of-law principles.
Changes to these terms
If we make material changes, we'll update the effective date above and, where appropriate, notify account holders by email.
